Terms of Service

These Terms of Service (“Terms”) are an agreement between you and the individual who operates Shotfolio (“Shotfolio,” “we,” “us”), an independent project that is not a company, governing your access to and use of the Shotfolio website and service (the “Service”). By signing in or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. The Service

Shotfolio provides photographers with tools to host shareable client photo galleries, take session bookings, create and share invoices, and collect client intake questionnaires. We may add, change, or remove features over time.

3. Your account

You access the Service through Google or Microsoft sign-in. You are responsible for activity under your account and for keeping that sign-in account secure. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • Upload or share content you do not have the rights to, including photos of people without the consents required by law.
  • Use the Service for anything unlawful, infringing, defamatory, harassing, or harmful.
  • Upload malware, attempt to breach security, probe or scan the Service, or circumvent rate limits or access controls.
  • Reverse engineer, scrape, or build a competing product from the Service, except where the law expressly permits.
  • Misrepresent your identity or use the Service to impersonate others.

5. Your content and the license you grant us

You retain all ownership of the photos, text, and other content you upload (“Your Content”). To operate the Service, you grant Shotfolio a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content solely to provide and maintain the Service for you (for example, generating thumbnails and watermarked copies and serving gallery links). This license ends when you delete the content or your account, except for residual copies in routine backups for a limited time.

You represent and warrant that you own or have all rights, licenses, consents, and releases needed for Your Content and its use through the Service — including model or subject releases and any consents required to photograph and share images of identifiable people and minors.

6. Client and guest data — your responsibilities

When you collect or upload information about your clients and event guests through the Service, you are the controller / business for that information and Shotfolio acts as your processor / service provider, as described in our Privacy Policy. You are responsible for providing any required notices to, and obtaining any required consents from, your clients and guests, and for handling their data-rights requests. You agree to comply with all privacy and data-protection laws that apply to you.

7. Bookings — no payment processing

Shotfolio does not process payments. It is not a payment processor, money transmitter, escrow agent, or party to any transaction, booking, or engagement between you and your clients. Any payment, contract, or dispute is solely between you and your client.

Booking tools help you publish availability and let clients pick a time; they do not guarantee that a slot remains available, and Shotfolio is not responsible for missed, double-booked, or cancelled sessions.

8. Availability and changes

The Service may be offered free of charge and/or as a beta during early access. We do not promise any particular uptime or service level, and we may modify, suspend, or discontinue the Service or any feature at any time. We will give reasonable notice of significant changes where practical.

9. Third-party services

The Service relies on third parties (including Google, Microsoft, Amazon Web Services, Vercel, Upstash, and Resend). Your use of those services through Shotfolio may be subject to their own terms, and we are not responsible for them.

10. Our intellectual property

Shotfolio, its software, design, and the “Shotfolio” name and logo are owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our branding except as needed to use the Service.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content will be preserved without loss. Keep your own backups of important photos.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHOTFOLIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $1. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold Shotfolio harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party (including your clients and guests).

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. On termination, your right to use the Service ends; we may delete your content after a reasonable period, so export anything you want to keep beforehand.

15. Governing law and disputes

These Terms are governed by the laws of the place where the operator of Shotfolio resides, without regard to conflict-of-laws rules, and any dispute will be handled by the courts that have jurisdiction there. Nothing in these Terms removes any mandatory consumer-protection rights you have under the laws of your own country or state.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top and, where appropriate, provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.
